Drainage is the element of driveway design that homeowners most often overlook and regret most acutely. A driveway with inadequate drainage creates pooling that prevents car use, directs water toward the house foundation, causes flooding in adjacent gardens, and — where impermeable surfaces drain to the public highway — can constitute an offence under the Highways Act. Getting drainage right costs relatively little to include at the design stage and a great deal to retrofit.
The Legal Position on Run-Off
Since 2008, directing surface water run-off from a new front garden driveway onto the public highway has not been permitted without consent. Run-off must be managed on-site — either by using a permeable surface, or by directing water to a lawn, border, or purpose-built drainage structure such as a soakaway. This applies to England; equivalent provisions exist in Wales, Scotland, and Northern Ireland. A contractor who drains your driveway to the road without designing for on-site management is leaving you exposed to enforcement.
"The requirement to manage driveway surface water on-site is not widely understood by homeowners, and not always observed by contractors. The simplest compliance route is permeable surfacing. Where an impermeable surface is specified, a drainage channel directing run-off to a soakaway or planted area is the alternative."— SuDS — Surface Water Management Guidance
Channel Drains
A channel drain (linear drain) set into the driveway surface at a low point collects water and directs it to a soakaway, surface water drain, or planted area. The channel should be installed during the sub-base construction stage — installing one after the surface is laid requires cutting and relaying, which is why retrofitting is expensive. HDPE or stainless steel channels are more durable than concrete channels in driveways subject to regular vehicle loading. The channel cover grade should match the vehicle loading — standard domestic car loadings require a minimum Class B (EN 1433) rated cover.
Soakaway Design
A soakaway disperses collected water into the surrounding ground. To function correctly, it must be sized for the surface area draining to it and the permeability of the ground. A properly designed soakaway uses BRE Digest 365 calculations for sizing. Crate soakaways (modular polypropylene cells) are more efficient per cubic metre than traditional stone-filled pits and are easier to install in restricted spaces. A soakaway must be sited at least 5m from the house foundations and clear of any drainage runs.
"Soakaway sizing matters. An undersized soakaway fills in a moderate rain event and then fails to drain, backing water up the drain and defeating the purpose of the whole system. Sizing must account for the impermeable area draining to it and the soil infiltration rate, which varies enormously — from permeable sandy gravel to near-impermeable clay."— BRE Digest 365 — Soakaway Design (GOV.UK)
Driveway Gradient
A driveway should drain away from the house, ideally at a minimum gradient of 1:80. A surface that is perfectly flat will pool water at random low points. A surface that falls toward the house directs every rain event toward the foundations and potentially toward the DPC. Check the proposed gradient with your contractor before any work begins — this is not a detail to finalise after the sub-base is laid.
